Welcome to Hubble Star, an educational application owned and operated by TI ONE LLC (“Company,” “we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your access to and use of Hubble Star, including our website, mobile applications, and related services (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.

1. Eligibility and Account Management

1.1 Parental Accounts: Hubble Star is designed for learners from Pre-K through all grade levels and ages. For users under 18, accounts must be created and managed by a parent or legal guardian (“Parent”).

1.2 Parental Responsibility: Parents are fully responsible for supervising their child’s use of the Service and for ensuring compliance with these Terms.

1.3 Accuracy of Information: You agree to provide accurate and complete information during registration and to keep account details up to date.

2. Use of the Service

2.1 Hubble Star provides educational games, quizzes, and learning content in subjects including Math, Science, and other academic topics.

2.2 Users may participate in learning activities, earn points, and appear on leaderboards visible to other users.

2.3 The Service is provided solely for educational and entertainment purposes. Any misuse of the Service, including attempts to manipulate results or interfere with other users’ experiences, is prohibited.

3. Artificial Intelligence (AI)-Generated Content

3.1 Hubble Star uses artificial intelligence technologies to generate educational questions, games, and other interactive content.

3.2 By using the Service, Parents consent to their children being exposed to AI-generated content. While we strive to ensure quality and accuracy, we do not guarantee the completeness or appropriateness of such content for every user.

3.3 The Company is not liable for any inaccuracies or errors arising from AI-generated materials.

4. Privacy, Data Collection, and Advertising

4.1 Hubble Star collects certain information, including but not limited to a user’s name, grade, photo, email, and usage data, to personalize learning experiences and improve the Service.

4.2 All data collection and processing are governed by our Privacy Policy (available separately).

4.3 The Service complies with the Children’s Online Privacy Protection Act (COPPA) and other applicable child data protection laws.

4.4 Parents provide consent for the collection, use, and disclosure of their child’s data by creating and managing an account.

4.5 Third-party tools (such as Google Analytics, Google Login, and Facebook Login) may be used to enhance functionality. These services may collect and process limited information as described in their respective privacy policies.

4.6 No Sale of Children’s Data: The Company will not intentionally sell or rent children’s personal information to any third party. However, the Company shall not be held liable for any unauthorized access, security breaches, or hacking events beyond its reasonable control.

4.7 Advertising: The Service may display advertisements, including those delivered by third-party ad networks. The Company will make every reasonable effort to ensure ads are age-appropriate and suitable for the known age group of the user, but errors or inappropriate content may occasionally occur. By using the Service, you acknowledge that such mistakes may happen and agree that the Company is not liable for inadvertent ad display errors.

5. Public and Private Profiles

5.1 Each child’s account may be designated as Public or Private.

5.2 Private Profiles: Private profiles are visible only to the Parent and the child. Information such as the child’s name, photo, grade, and scores will not appear on leaderboards or be visible to other users. The Company will make reasonable efforts to protect the privacy and security of private profiles.

5.3 Public Profiles: Public profiles may appear on leaderboards, group results, or public achievements within the Service. Information that may be displayed includes the child’s first name, photo, grade, score, achievements, and related learning data. Parents understand and agree that by enabling a Public profile, such limited information becomes visible to other users of the Service.

5.4 Parental Control: Parents can choose, change, or revoke their child’s profile visibility (Public or Private) at any time through the Parent Portal. The Company is not responsible for unintended disclosure resulting from Parents’ chosen visibility settings.

5.5 The Company takes reasonable technical and administrative precautions to protect all user data; however, no system is fully secure, and the Company cannot guarantee complete protection from unauthorized access or misuse of publicly shared information.

6. Payments, Subscriptions, and In-App Purchases

6.1 Hubble Star offers free and paid subscription tiers. Paid plans may be billed monthly or annually, with possible promotional discounts.

6.2 In-app purchases may be offered for additional lessons, rewards, or other digital features.

6.3 All payments are processed through authorized third-party payment processors. By completing a purchase, you agree to their terms and conditions.

6.4 Subscriptions automatically renew unless canceled before the renewal date. You may manage or cancel your subscription at any time through your account settings or app store.

6.5 Fees are non-refundable except where required by law.

7. Intellectual Property

7.1 All content, designs, software, and materials provided through Hubble Star are the intellectual property of TI ONE LLC or its licensors.

7.2 You may not copy, modify, distribute, or reverse-engineer any part of the Service without prior written permission.

8. Third-Party Services

8.1 Hubble Star may integrate or rely on third-party services (e.g., Google Analytics, Facebook Login, or content hosting providers).

8.2 The Company is not responsible for the content, security, or practices of third-party services. Use of these services is subject to their own terms and policies.

9. Disclaimer of Warranties

9.1 The Service is provided “as is” and “as available,” without any warranties of any kind, express or implied.

9.2 TI ONE LLC disclaims all warranties, including merchantability, fitness for a particular purpose, and non-infringement.

9.3 The Company does not guarantee that the Service will be error-free, secure, or continuously available.

10. Limitation of Liability

To the maximum extent permitted by law, TI ONE LLC and its affiliates shall not be liable for any indirect, incidental, special, or consequential damages arising from the use or inability to use the Service, including but not limited to data breaches, unauthorized access, exposure to public leaderboards, or third-party advertisements, even if advised of the possibility of such damages.

11. Termination

11.1 The Company may suspend or terminate any account that violates these Terms or applicable laws.

11.2 Upon termination, all rights granted to you under these Terms shall cease immediately.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Washington, USA, without regard to its conflict of law principles. Any disputes shall be resolved exclusively in the state or federal courts located in Washington State.

13. Changes to These Terms

We may update or modify these Terms at any time. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
